The programs take a historical and critical approach to examining the foundations of legal order in South
Africa and the Global South as a whole, as well as the implications for current struggles for social and
political justice around the world. Before writing a mini dissertation, you will be required to complete
three coursework modules that cover:
(1) The constitutional theoretical debates underpinning contemporary South African jurisprudence.
(2) The historical and philosophical foundation of postwar human rights discourse and imagination.
(3) An Africa-centered inquiry into the philosophical foundations of "development" discourse and the
role of law and rights discourse in its unfolding.
