The Faculty of Law at the University of Pretoria (UP) is proud to announce that in its judgment of Hlumisa Investment Holdings (RF) Ltd v Kirkinis (Case no 1423/2018) [2020] ZASCA 83 (03 July 2020), the Supreme Court of Appeal has referred a number of times to and quoted substantially from Henochsberg on the Companies Act 71 of 2008, authored and edited by Piet Delport, an Emeritus Professor and Chair in Corporate Law and Corporate Governance at UP.
Henochsberg on the Companies Act 71 of 2008 has long been recognised as the leading work in the field of corporate law and corporate governance. This comprehensive work is maintained in three volumes with a full commentary on the sections of the Companies Act, which also includes a copy of the King IV Report on Corporate Governance for South Africa, 2016. Further Henochsberg refers extensively to case law, which impacts on the South African company law, including English authorities. This publication by LexisNexis is updated biannually of which the most recent update was in November 2019.
Prof Delport is widely known as the South African expert on Business Enterprise Law, which includes companies, close corporations, partnerships and business rescues (to mention but a few). He is also widely respected internationally. In 2019, after his official retirement from the Department of Mercantile Law, his home department, where he enjoyed an illustrious and influential career, he was appointed to the position of Chair in Corporate Law and Corporate Governance at the Faculty of Law at the University of Pretoria as of 1 January 2020 to further develop and enhance corporate law and corporate governance jurisprudence.
