Tuks SRC Elections 2015/2016 – Current Status

The SRC election processes at the University of Pretoria (UP) are overseen by the Independent Electoral Commission (IEC). They are responsible for election logistics, including polling and counting of votes.

In terms of the University’s Student Governance Constitution, an Independent Monitoring Body (IMB) is mandated to declare the SRC elections free and fair or to declare (parts of) the election process as null and void.

Before declaring an election free and fair, the IMB must attend to all complaints and objections. This part of the process is currently underway.

The IMB has already met twice this week to consider complaints. Currently, they are considering complaints received from Afriforum Jeug, EFFSC and SASCO.  In investigating the complaints, the IMB is dependent on the facts as provided by complainants, the IEC, and IMB members' own observations during the elections.

In terms of the Student Governance Constitution, the IEC is obliged to act on each complaint received and to provide a written record of action to the IMB as soon as reasonably possible. The IMB members have been careful to apply their minds to the allegations contained in each complaint and the IEC's response to each complaint.

On 4 September 2015 the IMB sent a list of questions for clarification to the IEC, to allow the IMB to fully understand the context surrounding each complaint.  After receiving the IEC's response to these questions, the IMB will meet again to consider each complaint, make a finding on each complaint, and then make its decision known on whether the elections were free and fair.

The IMB will meet again as soon as possible after receiving the IEC's response to the posed questions.

Until all investigations have been concluded, no final declaration on the election or its results can be made. The matter will, however, be dealt with expeditiously.
