UP Law successfully hosts second specialised short programme on 'Promotion and Protection of Investment in Africa'

Posted on May 20, 2022

During May 2022, the University of Pretoria’s (UP) Department of Public Law commenced with the delivery of the first module of a specialised short programme on ‘Promotion and Protection of Investment in Africa’ under the auspices of the Extractive Industry Law in Africa Unit (EILA).  The online programme, delivered in collaboration with Cliffe Dekker Hofmeyr and hosted by Enterprises University of Pretoria, offers a novel and unique introduction to the law and policy fundamentals of investment protection on the Africa continent.  This course follows on the first successful inaugural course which took place from 12 to 20 October 2020.

The curriculum, developed and presented by leading international industry and practice experts, holistically blends theoretical and practical discussions to guide attendees through (a) contemporary legal and policy aspects associated with investment law; (b) agreements governing the relationship between investors and states; and (c) how disputes can be addressed and resolved.

The first module introduced attendees to the fundamentals of International investment law.  Comprehensive discussions by leading international experts — including Ms Ndanga Kamau (Vice President, ICC International Court of Arbitration) and Professor Dr Maxi Scherer (Governing Board Member for the International Council for Commercial Arbitration) — provided a holistic overview of the international investment framework for intra-Africa and foreign direct investment on the continent.

The Unit Director of EILA, Adv Leon Gerber, emphasised the importance of continuous professional development in addition to formal postgraduate education.  He said: “Contemporary investment in African countries holds tremendous promise, but is also subject to a wide range of dynamic challenges.  Being able to disseminate such information in a flexible package, and in collaboration with a leading industry partner, ensures that attendees are sensitized to the latest practical considerations — such as the future AfCFTA Investment Protocol — when drafting investment agreements.”

In her congratulatory note, Professor Zozo Dyani-Mhango, Head of the Department of Public Law, expressed her appreciation to Gerber ‘on a job well done!’.

The second module will be delivered from 24 May to 2 June 2022, with the third module to be delivered from 14 June to 23 June 2022.
