Paper at International Insolvency Law Conference

A new Companies Act will come into force next year in South Africa and inter alia includes a controversial business rescue framework. The authors have been researching the intersection between insolvency, labour and company law principles within the new business rescue framework. A paper entitled “The expected impact of Labour Law principles on South Africa’s new corporate rescue mechanism (including a comparison with the position in the EU)” was co-presented with Prof David Burdette from Nottingham Law School, who is also an extraordinary professor at the Department of Mercantile Law.

American Judge Peck, who is presiding over the liquidation of Lehman Brothers, delivered an address at the same conference.

Prof van Eck said that the conference was a platform where the Department's interdisciplinary research with international elements could be discussed with peers who also work in this area of the law.
