This year’s workshop focused on the topical matter of “Interdicting Strikes” and was eloquently presented by advocate Nick Smythe from the Johannesburg Bar.
Delegates received a comprehensive workbook which covers the 15 grounds for obtaining interdicts. The handout contains practical guidelines and examples of applications for interdicts. The constitutional limitations on the right to strike were dealt with, as well as the applicable provisions of the Labour Relations Act 66 of 1995. The Labour Court Rules were addressed extensively.
Practitioners made valuable input regarding the challenges posed by unprotected strikes in certain essential services such as the nursing profession. Concerns were also raised regarding the disregard of court orders by certain trade unions during the process of collective bargaining.
One of the organisers, Ms Ezette Gericke from the Department of Mercantile Law, said that this Workshop provided an excellent platform where students, practitioners and academics could exchange ideas and build networks in the area of Labour Law. Delegates suggested that this workshop should become an annual event.
