Practical Law (PRR) 400 | Guest Lecturer Series 

Prof. Muller presented a guest lecture on rental housing to the PRR400 class on Friday, 25 August 2023. During the guest lecture he sought to position the topic in a Janus-like position with references to KTH220 (specific contracts) and AGF420 (alternative dispute resolution). He spoke about the kinds of disputes that can arise between landlords and tenants with the regulatory framework that the Rental Housing Act 50 of 1999 and Rental Housing Amendment Act 35 of 2014 establish. He also covered how the Rental Housing Tribunals deal with complaints and facilitated a discussion on how an ‘unfair practice’ should be understood with reference to Maphango v Aengus Lifestyle Properties (Pty) 2012 (3) SA 531 (CC).

Professor Gustav Muller is an associate professor in the Department of Private Law where he teaches a compulsory undergraduate module in property law and an elective in land and related reforms. He coordinates two LLM modules – advanced general principles of property law and living together as neighbours – which forms part of the LLM (Private Law) programme. He holds a LLB and a LLD from Stellenbosch University and an Advanced Diploma from Åbo Akademi University in Turku, Finland.

He is the editor-in-chief of Silberberg and Schoeman’s The Law of Property 6th edition and Transformative Property Law – Festschrift in honour of AJ van der Walt and author of Property in Housing. He has published 22 journal articles, delivered 23 conference papers (local and international) and presented a keynote address to the Young Property Lawyers Forum. He has been cited twenty four times in various Divisions of the High Court of South Africa, the Supreme Court of Appeal and Constitutional Court. He is the co-founder of the property law reading group with 33 members in South Africa and is also the co-founder of the international resilient property law group with twelve members. He was recently invited to join the “Scientific Network on Eviction and Housing Rights” (SNEHR). The SNEHR is an academic network, which forms part of the EVICT-project (University of Groningen, The Netherlands). He is the host of two international research associates – Prof Lorna Fox-O’Mahony (Essex University) and Prof Marc Roark (Southern University Law Centre). Professor Muller was awarded a C2 rating by the NRF and was awarded the Exceptional Young Researcher award by the University of Pretoria in 2022.
