Extractive Industry Law in Africa Programme attends Brazilian Mining Law Seminar

On 7 December 2017, Adv Leon Gerber, Programme Coordinator of the Faculty’s Extractive Industry Law in Africa Programme, attended a mining law seminar hosted by the Embassy of Brazil (Pretoria).

The seminar, titled “The Legal Framework of the mining sector in Brazil and in South Africa” brought together representatives from government, industry and practice, and was aimed at providing a neutral forum for the discussion of comparative challenges between the mining sectors of Brazil and South Africa.

Eminent panellists included Peter Leon (Herbert Smith Freehills LLP) and Carlos Vilhena (Pinheiro Neto Advogados), with the seminar opened by H.E. Ambassador of Brazil, Nedilson Jorge and H.E. Deputy Minister of Mineral Resources, Godfrey Oliphant, MP.

Discussions raised a range of matters, including the benefits and limitations of National Mining Agencies;  challenges associated with obtaining social license to operate from affected communities, and questions surrounding the formalisation of the artisanal mining sectors. The seminar further allowed panellists and audience members from both countries to find common ground, with an emphasis on the need to offer a stable and certain legal framework in order to foster and retain investor confidence in the sectors.
