Constitution

  There shall exist a voluntary association not for gain entitled the South African Association of Education Law and Policy (hereinafter called "the Association").

  The Association shall be a juristic person acquiring rights and incurring debts or sustaining liability only in its own name.

  Subject to the provisions of this Constitution, the management of the Association shall vest in the executive committee and the general assembly.

  The Association expressly subscribes to the provisions in the Constitution of the Republic of South Africa, which outlaws unfair discrimination.

Goal and Achievement

 Goal

The goal of the Association is to make an effective contribution - in the interest of freedom, equity and quality in education and training in South Africa - to the study and development of education law (including fundamental rights in education) and education policy, and to further in everyone concerned increased knowledge and understanding of these disciplines.

  Achievement of goal

The Association may further its goal by any appropriate means, including -

 The publication of a journal, newsletter, information document, or the use of any other means of communication;

 The conduct of public lectures, information sessions, workshops, symposiums or similar occasions;

 Effective liaison with the South African education authorities on all levels;

 The stimulation of active participation in, and the influencing of, public debate on important matters concerning education;

 Appropriate co-operation with as many South Africa, foreign and international associations or institutions which have a similar object or which may advance the achievement of its goal by the Association;

  The active participation in programmes to assist the educationally disadvantaged members of society.

Membership

 The membership of the Association consists of all persons who have become members of the Association in terms of this Constitution.

 The executive committee of the Association may in its discretion, but subject to this Constitution and the rules of the Association, on the admission of any person as a member.

 Every member of the Association shall pay the yearly membership fee as determined by the executive committee to the Association.

 Every member of the Association enjoys the rights provided for in this Constitution and particularly the right to receive the publications of the Association on such conditions as the executive committee may determine.

 In accordance with rules made by the executive committee a differentiation may be made between founding members of the Association and those members who have joined the Association at a later stage, if there is an equitable and reasonable basis for such differentiation.

 Membership of the Association is terminated by the resignation in writing of a member, or by a written notice of termination by the executive committee when in its discretion there are reasonable grounds for such termination.
